Guardianships
Guardianships are possible under the Probate Code when neither parent is currently fit to raise the minor children. This may be because one parent is absent, temporarily incapacitated, or unavailable. A guardianship case will require an investigation by the Probate Court investigator. Once guardianship is appointed and letters are issued, a guardian will have similar rights to the parent. Our firm has also represented several clients who have successfully petitioned the Probate Court to terminate the guardianship and restore their parental rights.
